The question is what is in the best interest of the child? The dilemma is that this is mainly governed by the law of the country in which the child resides. The law in the USA is different to the law in the UK. Each country will have the law written and interpreted by its courts. In the USA, if the biological parents of the child die, the child will be adopted by the surviving parent, normally the mother.
